Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Utah consumers can correct and move data

Beginning July 1, 2026, Utah consumers can request corrections to inaccurate personal data, considering its nature and purpose. On request, social media services must provide portable copies where technically feasible, in readily usable formats where practicable. Copies include social connections, user-created content, reactions, and related data, but exclude private or user-designated private content. When data is processed automatically, services must allow transfer to another data controller without barriers.

Utah backs data rights with enforcement

Beginning May 7, 2025, Utah's Division of Consumer Protection may identify qualifying open protocols; using one creates a rebuttable presumption of fair, nondiscriminatory access. Beginning July 1, 2026, the Division can impose administrative fines up to $2,500 per violation or sue to enforce the law. Courts can impose civil penalties up to $2,500 per violation, stop violations, and order unlawful gains returned and actual damages paid to injured consumers. Breaking an administrative or court order carries civil penalties up to $5,000 per violation. Courts must award the Division reasonable legal, court, and investigation costs when it obtains a judgment or court-ordered relief.

Social media sharing expands with fee limits

Beginning July 1, 2026, covered social media companies must offer open interfaces for user-chosen data sharing across services. These must support access to user-created content and notices of updates, using fair terms and simultaneous sharing. Companies must offer other services equivalent versions of internal interfaces and complete, accurate, updated instructions. Sharing or receiving data requires user consent through a prominent, accessible, always-available method; companies and third parties must follow applicable privacy notices and security practices. Companies may charge reasonable fees above reasonable, proportionate request limits. Entities run by religious organizations and exempt from state property tax are exempt; companies need not reveal proprietary algorithms, internal analyses, or operating methods, or transmit proprietary-format data without an open standard.
