Beginning May 7, 2025, Utah public-school students need commission approval for interscholastic activities designated for a different sex than their unamended birth certificate lists. This includes students undergoing or who have undergone gender transition. Approval covers only the relevant school year and remains subject to federal law and policies governing the activity. The commission decides based on what the evidence shows is more likely than not. It checks for safety risks substantially above the activity’s normal risks and likely material competitive advantages over same-age participants. It must develop physical-trait ranges by age and activity as available evidence allows, and consider those ranges, past participation, gender identity, and mental health. Students without required approval cannot participate in that activity, but the law preserves participation rights under applicable federal law.
The commission must schedule at least three private eligibility meetings each school year and notify associations of meeting dates and deadlines. Notices must arrive at least 14 days before a regular meeting; later notices trigger a private meeting within 60 days. The commission notifies the association and parents about that special meeting. Families may submit evidence and attend in person or electronically with their chosen medical professionals or witnesses. Requested evidence must directly relate to eligibility; the commission may offer a voucher for a required diagnostic assessment when insurance or free services do not cover it. If more information is needed, another meeting must occur within 30 days; written decisions and reasons go to the association within 30 days after the determination. Schools must follow the decision, and disclosure limits protect the student’s identity and eligibility information.
The law broadens who can fill two House-appointed commission seats and removes the physician seat’s board-certification requirement. That seat accepts endocrinologists, family medicine doctors, or pediatricians with gender-identity healthcare expertise. The other accepts sports or exercise physiologists, sports medicine doctors, pediatricians with youth-sports experience, orthopedists, or orthopedic surgeons. Student eligibility meetings can proceed with no more than one core appointed seat vacant; other meetings require all appointed core members for a quorum. The Utah Department of Government Operations must provide administrative staff support, with no funding amount specified.
Athletic associations must collect each student’s unamended birth certificate or an allowed substitute as a condition of registration. The certificate may include unrelated amendments, but gender-related changes count only when they meet the law’s specified error-correction exceptions. Noncitizen students unable to provide the certificate may use specified identification, such as a state ID or passport, or other allowed reliable proof when those are unavailable. Homeless students may use the required affidavit plus one supporting document. Public schools cannot join or pay dues to associations that fail to collect the required records; schools also retain their own eligibility-check duties.
