Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Clearer chatbot labels and advertising limits

Beginning May 7, 2025, mental health chatbots must clearly tell Utah users they are AI, not people. Disclosure is required before feature access, after seven days without access, and whenever users ask whether AI is used. Ads for specific products or services during chats must be clearly labeled and disclose sponsorships, business ties, or promotion agreements. Suppliers cannot use chat inputs to decide whether to show ads, choose advertised products or categories, or tailor presentation. The exception only allows using inputs to decide whether to show an ad for the chatbot itself.

Privacy protections for Utah chatbot users

Beginning May 7, 2025, suppliers cannot sell or share covered Utah users’ identifiable health information or chat inputs. Covered users are people located in Utah using generative AI chatbots that hold conversations resembling private talks with therapists. Health information can go to a provider at the user’s request and with consent, or their health plan upon request. Necessary health information can also go to contracted parties that help run the chatbot, subject to federal health privacy rules. These exceptions do not otherwise allow sharing chat inputs.

Utah enforces mental health chatbot protections

Beginning May 7, 2025, Utah’s Division of Consumer Protection enforces the chatbot rules and can issue rules for enforcement. Its rulemaking includes procedures for a public violator list and removal from that list. The Division can impose administrative fines up to $2,500 per violation; courts can impose civil fines up to $2,500 per violation. Courts can stop violations, order surrender of improper gains and payments to injured consumers, and award the Division enforcement costs. Breaking an administrative or court enforcement order carries a court penalty up to $5,000 per violation. Fines and penalties go to the Consumer Protection Education and Training Fund.

Chatbot suppliers gain defense with safeguards

Beginning May 7, 2025, mental health chatbot suppliers gain a legal defense in specified civil or administrative licensing-related cases. To qualify, suppliers must create, maintain, implement, and file a written policy, keep required records, and follow that policy. Policies must explain intended uses and limits, therapist oversight, clinical practices, safety instructions, AI notices, and privacy protections. They must cover testing before launch, ongoing tests and audits, harm reporting, urgent-risk responses, and reviews of safety and accuracy. Testing must check that outputs pose no greater risk than treatment by licensed therapists; policies must prioritize safety over profit and prevent discrimination. Records must cover models, training data, data practices, privacy compliance, and ongoing accuracy, fairness, reliability, and safety efforts. Suppliers must pay a filing fee; the Division can also charge an annual fee, with neither amount stated in the law. Suppliers must follow the filed policy when the alleged violation occurs; the defense neither blocks Division enforcement nor licenses chatbots as therapists.
