4 provisions identified: 2 benefits, 0 costs, 2 mixed.
Beginning May 7, 2025, qualified dentists can dispense prescriptions at licensed dispensing practices, and eligible practices can dispense gabapentin. Drugs must come in fixed-quantity packaging under the treating practitioner's prescription, and patients need a same-day evaluation. The prescriber must regularly practice at that location. Generally, the treated condition cannot be expected to last over 30 days; prescription fluoride dispensed by dentists is exempt. The 30-day supply limit still applies, and controlled substances and drugs barred by the state remain excluded.
Beginning May 7, 2025, providers can reject credit-card or similar payments across an insurer's plans through one opt-out process. That choice lasts until the provider opts back in or a new contract is issued. Insurers must allow payment by paper check. This changes provider payments, not household benefits.
Beginning May 7, 2025, dentists must make reasonable efforts to warn patients when planned services may not be covered. Dental plans cannot use contracted fees to lower covered-service payments in ways that block collection of the actual service's contracted fee. That fee can come from the plan or patient. Plans also cannot block dentists from seeking the contracted fee from patients after denying payment for covered services. This denied-payment rule does not apply when accepted practice standards say the service should not be billed.
Beginning May 7, 2025, dental providers must return overpayments within 60 days after the insurer sends notice. They can repay by check or another method. Beginning January 1, 2026, insurers cannot automatically recover these overpayments until more than 60 days after sending notice. Providers can agree to earlier automatic recovery. These rules do not create a new patient payment duty.
