More investment flexibility for public insurance funds

Public agency insurance mutuals are exempt from Utah’s State Money Management Act; interlocal entities generally remain covered. The state treasurer must invest mutual assets for stability, income, and principal growth, using reasonable care, skill, and caution. The treasurer must consider investment purposes, terms, and payout needs, and can hire professional managers. Reserve funds—not mutuals—can buy securities listed in Section 51-7-11(3)(g) through (k) with up to 20 years remaining. That maturity limit does not apply when funds are pledged or otherwise deposited in an irrevocable trust escrow account.

Public insurance funds gain in-house insurer options

Public agency insurance mutuals and reserve funds can form one or more captive insurance companies. These are in-house insurers used to manage insurance risk. They must be formed under Utah’s Captive Insurance Companies Act. This authority does not provide a direct household payment or benefit.
