More air permit guidance for businesses

Beginning May 7, 2025, Utah's air agency must provide guidance and rules for facility-wide air pollution limits. These limits give facilities flexibility to change operations while staying within an overall emissions cap. Rules must cover applications, reopening or adjusting limits, facility input on changes, and public participation when limits are reopened. They must follow federal clean air law; guidance must match EPA's August 4, 2020 memo and consider other states' programs. The agency must publish guidance online, share it with facilities that may benefit, and provide individual help on request. By November 30 each year, it must report approvals, rejections, and recommended improvements to the Legislature's natural resources interim committee. These requirements end July 1, 2026.

More air permit options for businesses

Beginning May 7, 2025, Utah's air agency must study expanding its permit-by-rule program, which sets standard rules for source categories. By November 30, 2025, it must adopt rules adding at least five categories from the law's list. Listed categories include boilers, concrete batch plants, fuel dispensing, and small engines or generators. By that date, the agency must also report expansion recommendations, needed legal changes, and estimated effects on air quality, permit processing, and regulated sources to the Legislature's natural resources interim committee. These study, expansion, and reporting requirements end July 1, 2026.
