Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Stronger record access rights for homeowners

Utah homeowners’ and condominium associations must keep and share required records, including governing documents, approved minutes, budgets, financial statements, reserve analyses, and insurance certificates. Associations with active websites must post listed records free; others must offer physical copies during business hours at their registered address. The posting and physical-copy rules exclude associations defined in Utah Code Section 57-19-2. Owners must request access in writing with identifying information; associations may redact Social Security numbers, bank accounts, and privileged lawyer communications. For denied access, owners can seek $1,000 or actual damages, whichever is greater—up from the former $500 statutory amount. Before suing, owners must give written notice identifying themselves, the violation, the demanded fix, and a deadline at least 10 days after delivery. The association must miss that deadline, and owners must wait at least 10 days after notice before filing. A $25 daily penalty starts on day six for violations involving specified records. Courts may award the winning side costs and reasonable attorney fees, including qualifying pre-filing fees, but recovery is not guaranteed.

Protecting homeowners’ payments from developer defense costs

While a developer still controls the association, the developer cannot use owners’ association payments for its legal defense in covered lawsuits. This applies to actions brought before that control ends, solely by one or more owners against the developer.

Higher record copying charges for homeowners

Utah homeowners’ and condominium associations may charge for requested copies or electronic scans of records. Charges are capped at 10 cents per page plus staff time at no more than $20 per hour. The hourly cap rises from $15 to $20; associations do not have to charge the maximum. Alternatively, charges may equal the actual cost of a recognized outside copying service.
