Mortgage applicants gain protections against misleading offers

Beginning May 7, 2025, Utah restricts competing mortgage offers based on credit-report information shared with an unrelated third party. These rules protect people who applied for a mortgage at another financial institution. The sender’s first offer must disclose that it is not affiliated with the original mortgage company or broker. Senders must follow solicitation laws, including the firm-offer-of-credit requirement, and cannot knowingly offer rates, terms, or costs they will later worsen. Utah’s Division of Real Estate may issue citations for violations.
