Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Property-loss payments for nearby residents and businesses

Beginning May 7, 2025, Utah provides a new payment program for property losses directly caused by a homeless services facility’s presence. Utah residents must live within 0.2 miles and meet the law’s need requirements; businesses must be within that distance. Businesses must also be in good standing with the Utah State Tax Commission and Department of Commerce. Covered losses include personal property damage or theft and documented costs to clean, sanitize, repair, or restore real property. Claims must include closed insurance claim information and any settlement amount. Payments can fill gaps in other government or private aid but cannot duplicate or replace it. The business at parcel 15-26-326-016-0000 is excluded. The law sets no payment amount per recipient, and this program ends July 1, 2028.

Interest-free business loans with possible certificate fees

Beginning May 7, 2025, businesses within 0.2 miles of a homeless services facility can qualify for interest-free property-loss loans. The loss must directly result from the facility’s presence, and businesses must have good standing with both state agencies. Businesses must agree to use loans for documented loss costs or steps to limit that loss. Required records include closed insurance claim details and settlement amounts; repayment is due within one year after disbursement. The Utah State Tax Commission and Department of Commerce may charge small fees for required good-standing certificates. The law sets no loan amount or certificate fee amount. The business at parcel 15-26-326-016-0000 is excluded, and the loan program and fee authority end July 1, 2028.

State funds nearby property-loss assistance

The law creates the Property Loss Related to Homelessness Compensation Enterprise Fund, run by Utah’s Office of Homeless Services. It provides a one-time $10,000 from the General Fund for fiscal year 2026, July 1, 2025–June 30, 2026. Beginning May 7, 2025, appropriated fund money can carry over after the fiscal year ends. Gifts, grants, donations, other private contributions, and loan repayments can also support the fund; repayments must return to it. Administrative and operating costs are limited to 4% of fund revenues, including appropriations. When money is available, the Office must announce a yearly loan-application period and set application and priority rules. The program is scheduled for repeal and sunset review by July 1, 2028; the carryover provision has no separate sunset.
