Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Some automatic metal theft felonies removed

Beginning July 1, 2025, Utah removes special automatic third-degree-felony rules from retail theft, general theft, theft by deception, and extortion. The removed rules covered catalytic converters and certain suspect metals worth less than $5,000. The suspect-metal rules included a 25-pound minimum, aluminum or copper content, and an exclusion for lead batteries. Retail theft still follows its remaining value and prior-conviction rules. Metal theft is addressed under a separate offense with its own penalties, so removing these rules does not guarantee a lower charge.

Metal thieves face a separate crime

Beginning July 1, 2025, Utah creates a separate crime for taking another person's metal or catalytic converter without permission. Theft worth $5,000 or more, or theft from a person, is a second-degree felony. Third-degree felonies cover theft worth $1,500–$4,999, catalytic converters, and qualifying suspect metal weighing at least 25 pounds. Theft worth $500–$1,499 is a class A misdemeanor; below $500, the baseline is a class B misdemeanor. Prior convictions and merchant reentry bans can raise the charge. The law also treats regulated-metal wire as suspect metal when it is burned or looks burned.

More crimes count toward racketeering cases

Beginning July 1, 2025, metal or catalytic-converter theft can count toward a Utah racketeering case. The law also updates covered crimes involving gambling, prostitution, communications fraud, money laundering, and certain tax offenses. A pattern requires at least three related episodes, not isolated acts. At least one act must occur after July 31, 1981, and the latest must fall within five years of the preceding act.
