Utah prosecutors who filed charges against someone whose DNA was collected must explain how to request sample destruction and record removal. Notice is required after a final acquittal or dismissal with prejudice, meaning those charges cannot be refiled. It is also required when a final judgment reverses the conviction, judgment, or other order that required DNA submission. The notice does not automatically destroy the sample or remove the record.
Utah law enforcement can process booking DNA after a court sends a felony charge forward for trial following a preliminary hearing. Processing is also allowed after a preliminary hearing waiver or a grand jury indictment. Each felony charge must come from the same criminal episode as the booking. Another trigger allows processing when an arrest warrant remains outstanding 60 days after issuance. That warrant rule covers samples collected before, on, or after May 7, 2025.
People booked in Utah for offenses requiring DNA collection owe a $150 fee after a qualifying conviction. The conviction must be for a class A misdemeanor or felony from the booking charge or the same criminal episode. The fee does not apply if the person's DNA sample is already on file under the law.
