Consumers face tighter privacy lawsuit limits

Beginning May 7, 2025, consumers can bring only individual lawsuits under this law; class actions and representative cases are barred. You must have had a consumer transaction with the covered business, which obtained your nonpublic personal information through that transaction. The business must also have violated the law, and you must sue within one year after the transaction—not after discovering the violation. Cases can be filed in a federal or state court with authority to hear them. The existing remedy remains $500 for each failure to give you the required notice, plus court costs.

Fewer businesses covered by Utah privacy law

Beginning May 7, 2025, this Utah privacy law covers only businesses with a qualifying Utah office that routinely serves Utah consumers there. The office must be staffed, open to the public during normal business hours, and used mainly for those transactions. Post office boxes, mailing addresses, registered agents, and virtual offices used only for correspondence do not qualify. Government entities and businesses providing services for them are excluded. Covered consumer transactions include sales, leases, transfers, and personal or household credit initiated or completed in Utah, plus related offers, agreements, performance, and solicitations. Consumers dealing with businesses outside these limits lose this law’s protections.
