Beginning July 1, 2025, Utah government entities subject to suit must keep accurate public contact statements. They file these with the Division of Corporations and Commercial Code. Statements list business names, designated contacts, and physical addresses for sending claims and court papers. Entities cannot challenge delivery to the wrong office or agent when their missing or outdated statement caused the mistake. This protection applies only when the entity had actual notice of the claim or court papers.
Beginning July 1, 2025, some claimants face a proof requirement when governments challenge claim delivery or service of court papers. It applies when a claimant counters the challenge by pointing to the government's use of a different business name. The claimant must prove that reasonable efforts could not reveal the government's identity. This burden applies only when the challenge is not already barred by the government's filing failure and actual notice.
