New defense fund for Utah kids

Beginning May 7, 2025, Utah’s new Youth Defense Fund supports effective legal defense for minors who cannot afford lawyers in juvenile court. It pays appointed defense providers, needed defense resources, and costs to manage the fund and providers. This support is available only in counties that join and keep their required payments current. The Utah Indigent Defense Commission and Office of Indigent Defense Services run the fund, approve county applications and payments, and contract with qualified defense providers. County payments, legislative funding, and investment earnings support the fund; the state treasurer invests its money, with earnings staying in the fund.

Counties pay for youth defense support

Beginning May 7, 2025, counties can choose to join the Youth Defense Fund by passing a resolution accepting payment duties and submitting a certified copy to the commission. Participating counties must pay the amount set by the Office of Indigent Defense Services by January 15 each year. To leave, counties must pass a withdrawal resolution and notify the commission by January 1 of the withdrawal year. The commission can revoke participation for nonpayment; counties that leave or lose participation forfeit past payments and fund benefits, including reimbursement for costs after their paid period ends. Leaving also does not erase payment duties from their participation period. Utah is responsible for fund shortfalls, and the office must seek extra legislative funding in the next general session for actual or projected shortfalls. After a shortfall year, county assessments must rise by at least the prior year’s shortfall, and the state must pay money into the fund to cover the deficit.
