Utah’s Department of Environmental Quality must create a committee with its director or designee, two department representatives, and three local health department representatives. It reviews state and federal funding, resource allocations, policy changes, and environmental program coordination. It also reviews policies and rules affecting local health departments, estimating compliance costs and identifying available funding. Federal funding applications affecting local health departments need review before submission, unless exempt under the committee’s process. The department must report the committee’s findings to the Rules Review and General Oversight Committee before November 1 each year.
Utah’s Department of Environmental Quality must repay local health departments for costs of collecting civil penalties under Utah’s Environmental Quality Code. It may also use collected civil penalties to repay itself, local governments, or local health departments for qualifying extraordinary environmental enforcement costs. It may use criminal fines to repay those same entities for qualifying extraordinary costs of prosecuting violations of that code. The department must adopt rules defining qualifying work and expenses. These payments go to agencies, not households, and the law sets no reimbursement amounts.
Beginning May 7, 2025, each local health department must enter a cooperative agreement with Utah’s Department of Environmental Quality. These agreements replace the former environmental service-plan requirement and set each department’s duties. They provide for authority sharing where the law allows, the plan identifies the program, and the local department requests it. They also provide for needed transfers of federal, state, or other money and resources, as allowed by law. The agreements must be reviewed and updated each year.
