3 provisions identified: 1 benefits, 1 costs, 1 mixed.
Beginning May 7, 2025, providers cannot bill injured workers for unpaid balances on covered medical care. They cannot charge workers the difference between their bill and the payment from a workers’ compensation insurer or self-insured employer. This protection covers care under Utah’s workers’ compensation and occupational disease laws.
Beginning May 7, 2025, Utah’s Labor Commission must make fee rules for covered medical care, except hospital care. Any hospital fees the commission sets must be based on Medicare payment rates. Treating providers must follow commission rules for sharing relevant medical records and reporting workers’ conditions, treatment, and other case matters. Providers must send their first report to the Workers’ Compensation Division, the worker, and the employer or its insurer.
Beginning May 7, 2025, employers and their workers’ compensation insurers must report work deaths and qualifying injuries. Injuries qualify when they require medical treatment, cause unconsciousness, or lead to missed work, work restrictions, or job transfers. Utah’s Labor Commission sets reporting methods and deadlines and can require follow-up reports through reasonable rules considering practicality and cost. Employers need not report minor injuries needing first aid only, such as cuts or scratches. That exception does not apply when a treating doctor files, or must file, a report with the Workers’ Compensation Division.
