Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Stronger identity protections with limited exceptions

Beginning May 7, 2025, Utah expands identity protections to cover video likenesses, voices, audiovisual appearances, and technology-made recreations, including AI. Without consent, uses in advertising, fundraising, donation requests, or purchase solicitations are abuse when they suggest approval or confuse people about participation or connections. You can sue whoever caused publication to stop the use and seek proven damages, extra damages, and reasonable attorney fees and costs. Publishers face the same remedies when content plainly suggests you were unlikely to consent and they failed to reasonably check consent. Some promotions using lawfully obtained personal data or public information are excluded when they do not imply endorsement. The expanded identity definition does not apply to the existing criminal penalty; prosecution under that separate law remains available.

Ban on tools for identity abuse

Beginning May 7, 2025, Utah bans knowingly selling, distributing, or licensing tools mainly intended for unauthorized commercial identity use. This covers technology or software whose intended primary purpose is creating or changing content containing someone's identity without authorization.

Identity claim exceptions protect creative works

Beginning May 7, 2025, Utah exempts specified news, public affairs, sports, political campaigns, and public-interest accounts from identity-abuse rules and remedies. Exempt works also include books, plays, art, entertainment, commentary, criticism, parody, satire, and transformative works, plus ads for covered works. Sponsorship or paid ads alone do not make an identity use advertising or solicitation. Interactive computer services are not liable under these rules for content supplied by another person.
