New hearing rules for Utah horse racing

Beginning May 7, 2025, Utah Horse Racing Commission hearings on license denials, suspensions, revocations, and fines follow state informal hearing procedures. Applicants and license holders must receive written notice at least seven days before the hearing, at their last address on file. Hearings take place in the county where the commission has an office or another designated place. The commission can assign license denial, suspension, and fine hearings to a hearing officer. It must also adopt rules for board of stewards hearings and evidence, and stewards must follow them. Both bodies can administer oaths, issue subpoenas, require documents and other evidence, and manage hearings under commission rules.

Court appeals for racing decisions carry costs

Beginning May 7, 2025, people harmed by a final Utah Horse Racing Commission decision can appeal to a court. The decision takes effect immediately and stays in place unless a court pauses it. When the commission wins, the court must award Utah's Department of Agriculture and Food costs, fees, attorney fees, and court costs. The law sets no dollar amount for that award. People harmed by a final board of stewards decision can appeal to the commission under its rules. They can also ask the commission to pause that decision during the appeal.
