Beginning May 7, 2025, Utah private investigators face discipline for willfully withholding agreed services or reports. This applies when clients paid or offered payment as agreed. It does not apply when the investigator withdraws and refunds money for unfinished work. Unauthorized release of information gathered for a client also remains grounds for discipline. That rule covers release by the investigator, the client's employee, or the client's contract agent.
A Utah investigation agency gets temporary operating help when its only agent dies or becomes incapacitated. After receiving notice, the Bureau must allow an agent from another licensed agency to act for it. That permission lasts until the next scheduled or emergency board meeting. The board decides whether the agency can continue permanently or temporarily. If temporary operation is allowed, the board must give enough time to finish investigations started before the death or incapacity.
Utah's Bureau of Criminal Identification sets fees for individual and agency private investigator licenses and renewals. The law does not state fee amounts. Beginning May 7, 2027, licensees seeking renewal must submit proof of 16 hours of continuing education. This adds required training time and possible costs.
Utah private investigator identification cards must show agency, registrant, or apprentice license status. Cards must also show the license number, expiration date, and a current photo. When someone has reasonable cause to check a license, the licensee must immediately identify the agency. The licensee must also give an agency agent's name and phone number. These rules help people check credentials while adding duties for licensees.
Beginning May 7, 2025, Utah private investigator licensees must report name or address changes to the Bureau within 60 days. Missing that deadline is grounds for discipline. Business name or address changes require notice to the commissioner within 60 days; suspension requires evidence of knowingly failing to notify. Ending that suspension requires a reinstatement application and fee. Beginning May 7, 2025, the disciplinary section allows license suspension, revocation, and application denial, but no longer registration suspension or revocation.
