5 provisions identified: 4 benefits, 1 costs, 0 mixed.

Backup members for municipal services boards

Beginning May 7, 2025, city and county legislative bodies can appoint one of their members as a municipal services district alternate. Appointment requires a resolution, board qualifications, an oath, and crime insurance. Alternates act only when regular members are absent, unable, or refuse to act—not when regular members are present. They serve the regular member's term, and compensation can be divided between them. An alternate can chair only when all board members present at the meeting's designated physical location are alternates.

District boards must fill stalled vacancies

Beginning May 7, 2025, district boards must fill elected members' unexpired terms when the responsible city or county body delays. This duty starts after 90 calendar days without an appointment, counted from when that body becomes the appointing authority. The district board must have enough members for a quorum and follow the required public-notice process.

Filing dates for district board candidates

Special district candidates file June 1–7 in odd-numbered years for elections held with municipal general elections. They file June 1–7 in even-numbered years for elections held with regular general elections. Districts with four-day workweeks and at least eight office hours each workday allow filing during those hours. If the deadline falls on a scheduled nonbusiness day, filing extends through the next regular business day's office close.

Limits on automatic service district expansion

The law limits when municipal annexation or a boundary adjustment automatically adds an area to a special district. The district must be in a first-class county and provide fire protection, paramedic and emergency services, or law enforcement. No election to create the district can have been required. The whole municipality must already have been inside the district before the boundary change. Areas meeting these conditions automatically join the district, which can bring district fees, assessments, and service charges.

Shorter notice before district fee hearings

For new or higher district service fees, published hearing notices run at least 7 days, down from 30 days. Hearings remain at least 7 days after first posting and cannot start before 6 p.m. For first-time fees, districts can instead mail notice to those who will pay. The law does not itself raise fees, and these hearing rules do not cover impact fees.
