No officer sex with people in custody

The law says a person cannot consent to sexual relations while detained or in police custody. This includes traffic stops, questioning during an investigation, and any time under arrest or in custody. A police officer or other law enforcement official who detained, arrested, or has custody of the person cannot claim the sex was consensual. It also applies if the officer knows or should know the person is under arrest or in custody. "Law enforcement official" includes people who prevent, investigate, detain, or apprehend suspects; "sexual relations" includes sexual contact, intercourse, or sodomy.

AG must file prison abuse policy

Within 90 days after passage, the Attorney General must submit a prison sexual abuse policy to the Legislature. The policy must follow the federal Prison Rape Elimination Act standards. It must cover reporting, investigating, prosecution, conviction, and penalties for suspected sexual abuse by corrections officers.
