Big fines and jail for alcohol in commercial vehicles

If you are convicted of the 0.04% commercial offense, you face tiered penalties. First offense: $3,000 to $5,000 fine; the court may add up to 30 hours of community service. Second offense within 10 years: $6,000 to $10,000 fine and 60 hours of community service. Third or later within 10 years: $10,000 to $15,000 fine, 100 hours of service, and 30 days to 2 years in jail.

Stricter 0.04% alcohol limit for commercial drivers

It is illegal to drive or control a commercial motor vehicle with 0.04% or more blood alcohol. This applies on public roads when the vehicle is used in intrastate commerce. It covers vehicles with a gross vehicle weight rating or weight of 10,001 pounds or more. It also covers vehicles built to carry eight or more people, unless the Virgin Islands Taxicab Commission regulates them. It also covers vehicles carrying hazardous materials that need U.S. Department of Transportation placards.
