Advance parole hearing notice for victims
Beginning July 1, 2026, Corrections must notify victims of crimes listed in Vermont law at least 30 days before a parole hearing. The notice must give the hearing’s time and place and explain the right to testify or send a written statement. Corrections must promptly tell victims the decision and any parole release conditions. During a presumptive parole review, the Board must decide that a victim should have a chance to participate. Corrections must then notify that victim and provide that opportunity at a hearing; victims may waive notice.
Set review timing for eligible inmates
Beginning July 1, 2026, Vermont sets a review deadline for inmates eligible for presumptive parole. If an eligible inmate does not meet the law’s listed risk criteria, the Parole Board must review the case. This administrative review must occur during the 30 days before the inmate’s eligibility date. The review does not guarantee release.
Outside legal help for Parole Board
Beginning July 1, 2026, a Vermont pilot provides outside lawyers for Parole Board hearing advice and annual training, including due process and parole violations. The Board and Agency of Human Services must arrange contracts in coordination with the Attorney General. For fiscal year 2027, Corrections gets $50,000 in new General Fund money and carries forward $25,000 previously appropriated for legal services. The carried-forward money can only fund outside counsel for this pilot, needs no Secretary of Administration approval, and cannot be reallocated. By November 15, 2026, the Board Director must report to the House Corrections and Institutions and Senate Institutions committees with recommendations and resource needs. The pilot is evaluated during fiscal year 2028 budget planning to determine ongoing resource needs.
