Victims gain a voice in youth hearings

Beginning July 1, 2026, victims can attend Vermont hearings on youthful offender status and the court’s choice of consequences. They can give victim impact statements, share their views, and support restitution for crime-related losses. At both types of hearings, the court must ask whether a present victim wants to speak. If the victim is absent, the court must ask whether the victim shared views and consider those views. Missing notice or a victim’s absence does not delay or invalidate the proceeding.

Young offenders can face court pickup

Beginning July 1, 2026, missing a probation revocation hearing can lead to a court-ordered pickup in Vermont. The court can order an officer to bring the youth to court. It cannot issue that order if it finds good cause for the missed hearing.

Young offenders face treatment or adult supervision

Beginning July 1, 2026, Vermont courts have three options after finding that a youthful offender violated probation. They can keep youthful offender status with changed probation, send the case to adult court for sentencing, or transfer supervision to corrections. Corrections can use graduated sanctions and electronic monitoring. Before continuing youthful offender status, courts must weigh public safety, the youth’s ability to benefit from treatment, and available services. While a motion to revoke status is pending, Family Division authority continues until discharge or probation revocation, even past age 22 when needed.
