Patients gain remedies for banned AI care

Companies that break these rules also violate Vermont’s Consumer Protection Act, which the Attorney General can enforce. Private parties can use that law’s remedies, and other legal remedies remain available. A professional’s prohibited AI use counts as unprofessional conduct and can lead to license denial or discipline. This applies to conduct inside or outside Vermont. The law sets no specific compensation amounts or monetary penalties.

Stronger safeguards but fewer AI therapy options

Effective on passage, Vermont bars companies from offering or advertising mental health services unless a licensed mental health professional provides them. Research studies are exempt with institutional review board or privacy board approval and compliance with federal HIPAA research rules. Professionals may use AI within their scope of practice only with HIPAA-compliant tools, and must review and approve the services. FDA-authorized, cleared, or approved software medical products are allowed when a licensed professional prescribes or recommends them. These rules add professional safeguards but limit access to AI mental health services offered without professional oversight.
