Bill Overview
Analyzed Economic Effects
7 provisions identified: 2 benefits, 2 costs, 3 mixed.
More public access to care networks
Vermont’s Health Care Advocate can receive accountable care organization certification and budget review materials and participate in those reviews. The Advocate must protect confidential and proprietary information. Organization filings are available under Vermont’s public records law without directly or indirectly identifying individual patients or providers. Beginning July 1, 2025, meeting rules cover regular, special, emergency, electronic, and binding-action meetings of Medicaid care organization boards. They also cover entities coordinating two or more organizations that contract with Vermont Medicaid.
Simpler approval option for Medicare networks
The Green Mountain Care Board can create a simpler certification process for federally authorized Medicare accountable care organizations. These organizations coordinate care across providers. The approval covers only their Medicare work and only what federal authorization allows. The Board can still require one or more standard certification criteria. This does not change Medicare benefit amounts or patient costs.
Vermont ends Medicaid advisory rate review
Beginning July 1, 2025, the law removes Vermont’s Medicaid advisory rate-case process. The provided text does not name a replacement process. This repeal does not specify changes to Medicaid eligibility, benefits, payment rates, or household costs.
Hospitals face new budget procedures
General hospitals must start their fiscal year October 1; non-State psychiatric hospitals must start January 1. Beginning June 12, 2025, the Board must set covered psychiatric hospital budgets by December 15 each year. Written decisions are due December 31, and State-run psychiatric hospitals are excluded. Also beginning June 12, hospital budget review, setting, and enforcement are not handled as contested cases. A person harmed by a final Board action can still appeal.
Care networks face broader budget review
The Green Mountain Care Board must set budget rules for accountable care organizations, which coordinate care across providers. The rules cover organizations paid by Medicaid or commercial insurers for Vermont patients assigned to them. This replaces the prior distinction based on whether an organization served 10,000 assigned patients. The Board reviews, changes, and approves budgets, considering spending, administrative costs, provider collaboration, consumer input, and public comment. The law does not set household health care prices.
Vermont shifts health technology oversight
Beginning July 1, 2025, the Green Mountain Care Board no longer approves Vermont’s health technology plan or connection standards. It also loses approval over Vermont Information Technology Leaders’ budget and designation as the exclusive statewide health information exchange operator. The Department of Vermont Health Access can update the plan without Board approval. A Board representative gains a vote on the exchange steering committee. The Secretary of Digital Services replaces the Commissioner of Information and Innovation in reviewing state technology purchases using the plan.
New fees replace care networks’ assessment
Beginning July 1, 2025, accountable care organizations no longer pay an 8% share of Green Mountain Care Board expenses. The State pays 40%, hospitals pay 36%, and covered insurers and health maintenance organizations pay 24%. Insurer shares depend on premiums for covered products; the $150 minimum remains, with its offset reducing hospital and insurer assessments. Care organizations pay $10,000 for initial certification, $2,000 each following year, and $125,000 for each budget review. These are organization costs; the law does not specify changes to household premiums or medical bills.
