Washington law protects qualifying property sellers for purchase contracts signed on or after January 1, 2026. The buyer or their representative must actively seek to buy property that is not publicly available or listed for sale. This includes public advertising or written, electronic, or in-person contact. Neither side can have a licensed real estate broker for these protections to apply. You can choose a Washington-licensed appraiser, and the buyer pays the appraisal cost. The appraisal must be ordered within 3 business days after signing the contract, and you must notify the buyer. You can cancel without penalty or further obligation within 4 business days after receiving the appraisal. If you do not want an appraisal, you can cancel within 10 business days after signing the contract. Send written cancellation by mail, telegram, email, or delivery to the buyer’s designated business location. Notice counts when mailed, filed for telegraphic transmission, emailed, or delivered there. Contracts must explain both rights in at least 10-point boldface type and include your written acknowledgment. Violations are unfair or deceptive practices under Washington’s Consumer Protection Act. Existing rights under RCW 64.04.220 remain unchanged.
