New permit deadlines; state approval for landfills

Local health departments must approve or deny permit applications within 90 days. Landfill permits can be issued only after the state Department of Ecology approves them, and the state may require changes or deny. Any landfill permit issued after August 1, 2027, is not valid without prior state approval. For other waste facilities, the state reviews local permits within 30 days after issuance and can appeal if they do not meet laws, standards, or the solid waste plan. All permits must be renewed at least every five years; locals must decide renewals within 45 days after review, and may hold a public hearing if the renewal term is longer than one year. The state reviews renewals and must approve landfill renewals; applicants and local health departments can appeal a state landfill decision.

Stronger enforcement and higher daily fines

Agencies can issue compliance orders and fines up to $5,000 per day for days 1–14, and up to $10,000 per day after that. They should try education and outreach before fines. Paying one agency’s penalty reduces later penalties by others for the same incident. Local orders and penalties can be appealed to the local health officer; state orders and penalties can be appealed to the Pollution Control Hearings Board, which now hears these cases. Local governments lead enforcement, but the state can step in if locals delay: no inspection within 45 days, no notice within 60 days, no action within 90 days, or violations continue over 180 days. The state must give 30 days’ written notice before a penalty or order, unless there is immediate danger; if the local starts agreed enforcement within 30 days, the state holds its case. Owners and operators must allow inspections, sampling, and provide requested information.

Law stands only if funded by June 2025

This law depends on a named budget appropriation. If the legislature does not provide specific funding by June 30, 2025, the act is null and void. If the funding is provided by that date, the law remains in effect.
