Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Fingerprint checks for child care workers

Listed child care, group care, and child-placement applicants and providers must complete state and FBI fingerprint checks. Coverage includes listed license applicants, adults living in homes where children are placed, and group care workers. For listed hiring, promotion, transfer, job-reclassification, and contracted-service categories, checks apply after less than three consecutive years in Washington before applying. Another rule covers people age 16 or older who have lived in Washington less than three consecutive years. They must live in a listed applicant or provider setting, or be authorized child-service providers, and be outside state placement and care authority. Where unsupervised access is required, no same-organization worker or volunteer, or the child's relative or guardian, is present.

Fingerprint checks for adult care workers

Listed care applicants and providers must submit fingerprints to the Washington State Patrol for national FBI background checks. Covered roles include long-term care, direct care, child placement, high-risk providers, and specified administrators. Checks also cover listed residential habilitation, transitional care, and community residential service roles. Certain contractor, aging-agency, and tribal workers are covered only after less than three consecutive years in Washington before applying, with potential unsupervised access. People age 16 or older living in certified community residential companion homes also need checks. Unsupervised access means no worker or volunteer from the same organization, or the client's relative or guardian, is present.

State pays covered care workers' check fees

The responsible state department pays fingerprint-check fees for applicants and providers serving covered home and community long-term care programs. These are programs under Washington law chapters 74.39 and 74.39A, administered by either state social services or children's services. The department pays the Washington State Patrol and FBI charges. The law does not state a fee amount.
