New apprentice planning rules for contractors

Beginning July 1, 2026, bidders on Washington public works projects with apprentice-use requirements must submit a plan before receiving the notice to proceed. The awarding agency may exempt bidders that met or exceeded those requirements on their last completed public works project. Until July 1, 2027, bidders with past apprentice-use penalties or repeated use of the good-faith-effort exception must also submit a plan within 10 business days after that notice. The Department of Labor and Industries must provide a template and educational materials, and publish completed plans online. Plans must list project dates, total work hours, apprentice hours by occupation, state-registered apprenticeship programs, and estimated training agents or sponsors. Agencies may use their own templates with department approval if they meet these minimum requirements.

New qualification checks for public works contractors

Beginning July 1, 2027, Washington public works bidders must meet one of two qualification paths. They must have completed at least one public works project in the past three years without covered violation citations during that period. Or, a current employee or officer must have received public works and prevailing wage training within the past three years. Training must come from the Department of Labor and Industries or a provider using its approved curriculum. The department must post available qualification information, and agencies must check it before awarding contracts. Bidders must also submit a signed statement, under penalty of perjury, confirming no covered willful wage violations or related civil judgments in the three years before bid solicitation.
