Cities and counties can spend local real estate excise tax (REET) money on airport capital projects. The airport must be in the state aviation plan, or in the national plan with under 10,000 yearly enplanements based on the latest FAA data. REET cannot pay to install or improve systems that distribute leaded fuel. For the optional extra REET, only places that plan under state growth‑management rules can impose it directly. Counties that choose to plan, and the cities in those counties, need a majority vote to add the extra tax.
Starting with money collected after December 31, 2023, counties and cities that levy the extra REET must keep those dollars in a separate account. This rule improves tracking of how the money is used and adds a small administrative step for local governments.
