New PTD rates for injured workers

Beginning July 1, 2026, if you are found permanently and totally disabled and your claim date is on or after that day, your monthly check is a set share of your pre-injury wages. The rate is 60% if unmarried with no children, up to 75% for larger families. Married or single rates rise as the number of children goes up. The minimum $10-per-child add-on can count up to six children for new claims. Usual state wage caps and floors still apply.

2% to child’s custodian, worker offset

Beginning July 1, 2026, if your child is in someone else’s legal custody, that person gets 2% of your wages. Payments start only after the department is told about the custody. Your check, or your surviving spouse’s, is reduced by the same dollar amount paid to the custodian. These rules apply to claims with injuries on or after July 1, 2026.

Law is void without 2025 funding

The law requires specific funding in the state budget by June 30, 2025. If the omnibus appropriations act does not name and fund this law, it is null and void. Without that funding, none of the changes take effect.
