Washington’s Office of the Superintendent of Public Instruction must plan to take responsibility for basic education for justice-involved students. Beginning September 1, 2028, the office is responsible for ensuring effective services and improving students’ educational outcomes. Covered students are under 21, or older when required by law, and receive education through institutional programs. Their facilities must be outside the authority of the Department of Social and Health Services and Department of Corrections. The planning requirements take effect July 27, 2025, and expire June 30, 2028—not the ongoing education duties. The plan must consider the 2023 study, the December 1, 2022 final report, educator staffing and supports, and relevant laws enacted from 2024 onward. The office must consult groups representing students, educators, and others who support these services. It must carry out research recommendations for two service and management options and examine another that keeps school districts involved. The plan must explain service delivery and recommend oversight changes, including how to measure progress using educators’ input. The law requires annual progress reports to the governor and legislative education and fiscal committees from December 15, 2023, through 2027. Beginning September 1, 2028, the office must adopt and periodically update rules to carry out its responsibilities.
