Beginning June 11, 2026, Washington bans selling, supplying, administering, distributing, or giving away covered nitrous oxide containers. Offering to do these things is also banned. Covered devices, canisters, tanks, and other containers hold only nitrous oxide, flavored nitrous oxide, or a chemical compound mixed with nitrous oxide. Violations are gross misdemeanors. Exceptions cover medical, veterinary, or dental care by or under the direction or supervision of a Washington-licensed practitioner. Other exceptions cover sales of food products containing nitrous oxide as a propellant, manufacturers’ sales and use for manufacturing or industrial operations, and automotive sales and use. Cylinder filling is exempt for lawful distributors of medical, veterinary, dental, food-grade, industrial, or automotive gases. Those cylinders must be solely for exempt purposes and not for personal use.
