Beginning July 27, 2025, county clerks can ask a superior court to dispose of case exhibits more than five years after final judgment. With a signed order, the clerk gives exhibits of possible value to the sheriff for disposal under chapter 63.40 RCW. The clerk destroys other exhibits, unopened depositions, and reporters’ notes filed in the case. Reporters’ notes in criminal cases must be kept at least 15 years. Exhibits with historical value can go to libraries or historical societies, as the clerk decides.
