Fewer appeals of local review for energy projects

Beginning July 27, 2025, if a city or county works under an agreement with the council to give technical help or do application or plan review for a certified energy facility, that action cannot be appealed here as “inconsistent” with a preempted local code. This limit applies only to those council-agreement actions and only to that specific appeal reason.

State energy certification controls permits

Beginning July 27, 2025, a certification from the state Energy Facility Siting Council binds state and local governments. It authorizes the named company to build and run the facility, limited to the certification’s conditions. The certification replaces separate state or local permits. Agencies cannot add extra approvals beyond what the certification requires.
