Washington's Corrections and Health departments must adopt prison behavioral health standards by July 1, 2026. Corrections must fully use them beginning July 1, 2027, when Health must begin annual inspections and report noncompliance. Corrections must submit a corrective plan within 45 days and carry out fixes; Health may provide technical help. Corrections must pay Health's inspection and technical-help costs. By July 1, 2027, the departments must enter an inspection and payment agreement, renewed every two years. They must review and update standards by July 20, 2030, and every four years afterward. People serving the prison-based special drug offender sentencing alternative must receive substance use disorder treatment within available resources. Treatment providers must hold Washington licenses, but the treatment services no longer need separate Department of Health licensing. The entire act is null and void unless the omnibus appropriations act provides specific funding by June 30, 2025. That funding must reference this act by bill or chapter number.
