Beginning July 27, 2025, qualifying rural data center owners and tenants can count certain existing jobs toward tax-exemption requirements. This covers previously ineligible centers that receive certificates and previously qualified centers being refurbished. The jobs must serve the center and meet family-wage rules, but do not have to be new. Replacement servers also qualify at refurbished centers that were ineligible before June 9, 2022, and have valid exemption certificates. One rule requires installation and regular use within 12 years after the occupancy certificate or completion of refurbishment. For the construction category covering starts after June 30, 2015, and before July 1, 2035, a separate rule applies. That rule requires installation and regular use within 12 years after the exemption certificate date. These sales and use tax exemptions end July 1, 2048.
Beginning July 27, 2025, medical equipment vendors do not have to separately state or collect sales tax on qualifying sales. The insurer must pay a fixed amount set by its contract with the vendor. The vendor must be unable to collect any remaining balance from the covered person or anyone else. The sale remains taxable; this rule only changes how the vendor handles sales tax.
