More homes on county single-family lots

The law lets counties allow up to four homes on lots that now allow one house. This applies in designated rural development areas and inside urban growth areas. Counties cannot set tougher rules than for a single-family house, but can use objective rules like setbacks, lot coverage, stormwater, and tree retention. Middle housing uses the same permit and environmental review steps as a single-family house. Rural projects must use existing sewer lines, and urban projects must have water and sewer service.

Fewer appeals on local housing rules

Cities and counties that adopt rules to carry out these housing laws are not subject to certain environmental appeals. This includes actions under the 2022 housing law, most increased residential capacity actions, RCW 36.70A.635, and RCW 36.70A.680 and .681. For those 2022 and capacity actions, people can still appeal if the action likely causes significant harm to fish habitat. Inside urban growth areas, the Growth Management Hearings Board cannot hear cases claiming noncompliance based on these implementing actions. This speeds local rule changes but reduces those review paths.
