Beginning January 1, 2026, Washington’s Transportation Commission sets toll rates, exemptions, discounts, and collection fees outside the Administrative Procedure Act. The new process generally requires at least 30 days’ website notice before proposed rates take effect, plus public outreach. Changes must be adopted at an open meeting, and every toll-setting meeting must offer remote participation. The commission must notify the public and stakeholders within one week and post current rates and policies online. Emergency changes needed to meet state legal or financial duties can happen sooner, with notice and outreach as practical. Collection fees cannot exceed actual toll collection costs; the law sets no specific toll or fee increase. Toll-rate rulemakings already underway on January 1, 2026, must finish under the Administrative Procedure Act.
