Beginning June 11, 2026, the law clarifies that diesel is "special fuel" under RCW 82.38.020. Dyed diesel must follow the federal dyeing rule in 26 C.F.R. 48.4082-1T as of October 24, 2005. Sellers and distributors must follow these definitions when selling diesel in Washington.
Beginning June 11, 2026, the law updates which products count as motor fuel in Washington. Motor fuel includes any liquid or gas used to power vehicles on state roads. Alcohol fuel is alcohol not made from petroleum or natural gas, used alone or blended. Biodiesel must meet EPA fuel registration and ASTM standards. E85 must be about 75% to 85% ethanol and meet ASTM D5798. Renewable diesel must come from nonpetroleum sources and meet EPA Part 79 (2008) and ASTM D975. Ethanol blends may be sold only if the base fuel meets standards before mixing, or the final blend meets them after. Nonhazardous motor fuel means vehicle fuel that does not contain a hazardous liquid under RCW 19.122.
