Finishing worker checks and contractor enforcement

Beginning June 11, 2026, Washington’s Department of Labor and Industries must investigate worker misclassification after an eligible referral. This applies when a contractor or subcontractor uses at least three independent contractors for the same finishing work at once on a public works project. Covered work includes drywall, flooring, tiling, painting, and glazier and glasswork. Referrals can come from the awarding public agency, contractors or subcontractors on the project, unions representing covered workers, or covered workers on the project. If workers are misclassified, the hiring contractor or subcontractor faces all applicable public works wage requirements, liabilities, and penalties. The department must also make appropriate referrals to unemployment insurance and workers’ compensation programs.
