Agencies must report permit inventories and processing data by July 1, 2025. For permits lacking completeness or decision deadlines, the Secretary must propose rules within 60 days of April 9, 2025, including fast-track deadlines; legislative rules go to the 2026 regular session. Beginning January 1, 2027, agencies must refund all permit fees, including fast-track fees, when dashboard-filed applications miss decision deadlines. Direct agency filings do not qualify. The incomplete-application exception applies only when the agency sends dashboard notice within 10 business days of finding the problem, allows 30 days to fix it, and the applicant fails to submit a complete application on time.
Before July 1, 2027, covered permit applicants can keep using paper forms or existing agency websites without penalty or disadvantage. Beginning July 1, 2027, applications must go through the state dashboard. Alternative filing remains available when required by the Americans with Disabilities Act or West Virginia Human Rights Act.
West Virginia creates one online portal for covered construction, economic development, infrastructure, and natural resource permits by January 1, 2027. It covers Commerce, Environmental Protection, Environmental Health Services, Revenue, Tourism, Transportation, and the Secretary of State, with specified exclusions. Applicants can research permits, apply, renew, pay fees, track progress, contact agencies, and receive permits online; protected information stays private. The state can set program user fees and offer optional fast-track processing with shorter deadlines. Fast-track fees cannot exceed the agency’s extra processing cost, and participating agencies still make permit decisions.
