Beginning July 6, 2025, West Virginia sets penalty tiers for criminal conspiracies. The law applies when two or more people agree to a crime and at least one acts to advance it. It covers state crimes and fraud against the state, county school boards, counties, or municipalities. General felony conspiracies and these fraud conspiracies carry 1–5 years in prison, a fine up to $10,000, or both. Conspiracies involving violent felonies against people or felonies with minor-child victims carry 3–15 years in prison. A higher tier carries 5–25 years for crimes punishable by life imprisonment or offenses under §61-2-14a, §61-3-1, or §61-8B-3. That higher tier takes priority over the lower felony tiers. Misdemeanor conspiracies carry up to one year in jail, a fine up to $1,000, or both. This section does not override the other laws it specifically lists.
