New limits on local fire fees

In West Virginia counties with a county fire fee, municipalities face new limits on fees charged outside their borders. New municipal fire fees effective on or after June 30, 2024, require an agreement with the county commission. Outside municipal borders, the agreement can cover only people and businesses in the municipal fire service’s first-response area. It must require equal municipal fees inside and outside municipal borders and prevent duplicate county and municipal fire charges. The first year requires a proportional settling of charges and a transfer of county money. After that year, covered people and businesses pay only the same municipal fire fees charged inside municipal borders. Agreements expire after five years and can be renewed for terms of up to five years each. Municipalities can raise or lower fees in effect before June 30, 2024, only through changes applied uniformly to everyone charged.
