Tighter property rules for small estates

Beginning July 9, 2025, West Virginia excludes estates containing real estate that passes through probate from its simplified affidavit process. This includes any ownership interest in such real estate, regardless of value. The process requires the person who died to have been legally domiciled in West Virginia. The estate’s personal assets must consist only of qualifying small assets worth no more than $50,000 total. Estates with probate real estate must use standard probate administration instead.
