Pet food registrants pay an extra $50 per product each year for packages over 10 pounds or bulk sales. The extra fee is $35 per product for packages of 10 pounds or less that are not sold in bulk. The money goes to the West Virginia Spay Neuter Assistance Fund, supporting services performed in-state by licensed veterinarians. The law removes the sunset on these fee deposits, making this funding permanent.
The law defines feed as animal-consumption materials, including raw materials, ingredients, and finished products, that add nutrition, taste, aroma, or another technical effect. Businesses can call an ingredient “processed” only when its nutrition has not changed from its original form. Sellers cannot distribute adulterated whole seed, hay, straw, stover, silage, cobs, husks, or hulls as commercial feed. West Virginia’s agriculture commissioner can set manufacturing, processing, and packaging rules to protect drug safety and quality in medicated feed. This authority includes adopting federal rules for Type A medicated articles and Type B and Type C medicated feeds.
