Faster payments for road damage claims

Beginning July 7, 2025, West Virginia provides a faster process for property damage claims caused by state road conditions. The Division of Highways must agree to the full claim or a specific amount of $3,000 or less. Claims tied to a current-year appropriation do not qualify. The House Clerk prepares the agreement for Claims Commission approval, then sends the claimant a release to sign and return. After receiving the signed release, the Division certifies the approved claim for payment. The State Auditor issues payment without further claim review, checking only that enough money remains in the relevant appropriation.
