3 provisions identified: 2 benefits, 1 costs, 0 mixed.
An injured person can sue in the county circuit court where the violation occurred. Suits must start within two years after the violation was discovered or reasonably should have been discovered. Winning plaintiffs receive reasonable attorney fees and costs, and may receive actual, compensatory, or punitive damages and court orders. The Attorney General can also seek court declarations and temporary or permanent orders without posting a bond, after proper notice. State enforcement does not take away an injured person's separate right to sue. These actions and remedies do not apply when the institution has a written policy banning discrimination as defined by the law.
Financial institutions under covered West Virginia government contracts cannot deny or end services solely because of a business's lawful firearm activities. Protections cover firearm, ammunition, and accessory businesses, shooting ranges, and firearm trade groups. Covered institutions include banks, trust companies, credit unions, and credit card system operators. Decisions based on law, regulators' orders, or genuine business risks remain allowed; firearm status alone is not a valid business reason. Vendor policies limiting firearm-product listings or sales are excluded. Institutions with written policies banning the discrimination defined by this law are exempt.
Beginning 90 days after passage, West Virginia government entities cannot sign new contracts with financial institutions that violate the law. Sole-source providers are exempt; investment-service agreements, courts, and the Legislature are outside the covered contracting rules. Covered contracts must allow termination within one year after the government entity finds a violation. The Attorney General must report violators to the Governor and request that the state end its business relationship. The relationship must end within one year in a commercially reasonable way.
