Beginning June 12, 2026, people in West Virginia have the right to timely medical treatment or medical forensic care after a sexual offense, in a private, age‑appropriate space. It is a felony to injure, threaten, or interfere with someone seeking that care; punishment is 5 to 15 years in prison, up to a $50,000 fine, or both. It is also a felony to knowingly force or coerce a victim who became pregnant from the assault to have an illegal abortion. "Force or coerce" means using, trying to use, or threatening physical harm to make a woman end the pregnancy; sharing information or counseling about options is not coercion. Two or more people who conspire to do either crime also commit a felony with the same penalties, and the victim is not criminally liable.
